By clicking the box I hereby agree that I have enrolled in a program of strenuous physical activity including but not limited to aerobic movement, weight training and various aerobic conditioning machinery ordered by M.TRAIN LLC. I hereby affirm that I am in good physical condition and do not suffer from any disability that would prevent or limit my participation in this exercise program. In consideration of my participation in the M.TRAIN LLC exercise program, I for myself, my heirs and assigns, hereby release M.TRAIN LLC (it's employees and owners) from any claims, demands, and causes of action arising from my participation in the exercise program. I fully understand that I may injure myself as a result of my participation in M.TRAIN, LLC exercise program and I hereby release M.TRAIN LLC from any liability now or in the future however caused, occurring during or after my participation in the exercise program.
In consideration of participating on the Monkey Bar and Overhead Rope/Ladder System at M.TRAIN LLC, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe conditions are unsafe, I will immediately discontinue participation in the Activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which this event takes place, or the negligence of the "releases" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for loses, cost, and damages I incur as a result of my participation in the Activity.
Further, I grant to M.TRAIN LLC the absolute and irrevocable right and unrestricted permission concerning any photographs/videos that he/she has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs/videos in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if he/she so chooses. I release and discharge M.TRAIN from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of M.TRAIN LLC, as well as the person(s) for whom he/she took the photographs.
I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns I hereby affirm that I have read and fully understand the above.
